Well, he may have time to make those before his next outing. But the Mariners are running out of time to make this season into something more than just another training session for kids. They had generated all sorts of positive momentum coming off that road trip and after blowing the Red Sox off the field on Monday night. Then, they gave Iwakuma a 5-1 lead by the second inning of this one and he tossed it away. Like so many others the Mariners have junked with an ace or a closer on the mound.
This team doesn t have that many wins to spare. It struggles to win more than two in a row at the best of times because guys aren t getting the pitching and the hitting synched up. We can point the finger at injuries and say this team hasn t had a full compliment of players all year, but the truth is that Raul Ibanez s numbers have more than offset the loss of full-timer Michael Morse.?Franklin Gutierrez hasn t stayed healthy since 2009 and the really gut-wrenching losses this year have by-and-large been as a result of the work of healthy-pitchers.
Tonight s game had nothing to do with injuries. It had to do with a veteran starter not getting it done and the bullpen following suit.
David Ortiz stole a base off an otherwise preoccupied Carter Capps in the eighth inning. It s nice that Capps was trying to work his slider in more, but the basics of the game call for you to look the runner back to first from time to time, not merely focus on getting your work in like it s spring training. That s been part of the problem here in Seattle the past few years, where games by July tend to mean so little in the standings that the MLB club serves as a young player schooling ground instead of a finished product you charge full price to watch.
Which is great, except the fans in the stands and the ones who write in to me daily and phone in on radio were actually excited about the team of the past week because it showed signs of winning again and let them think that maybe, just maybe, this summer could be more interesting. Well, I suppose it will be until August, when football training camp opens and all except a few diehards stick around to watch a team groom players for 2014, 2015 and beyond.
But for a team to hold anyone s interest for more than a week or two beyond July as the Mariners did for a mild streak last August that turned out to be just another tease that meant little you have to be able to win games with some consistency. The Mariners instead keep giving away the ones they should be locking up and that s all part of learning how to win. It s not just about collecting stats.
Even after Iwakuma bailed three innings into this game, the Mariners still took a 7-6 lead and had a shot at winning after chasing ineffective Boston starter Allen Webster just 2 1/3 innings in and getting some hits off the first reliever who followed. But then Craig Breslow came on, shut the Mariners down for the most part and wound up earning the win.
Blake Beavan came on for Seattle having not pitched in nine days and gave up a run in the fourth, then another in the fifth. After that, Capps, Charlie Furbush and company allowed three more runs in the eighth to turn a close one into an easy ninth-inning save opportunity for Boston.

Look, I get the whole rebuilding thing and that it takes time for some players to progress. But wins and losses are part of any development plan and this team if it keeps tossing wins away will take a step backward in overall record from last year and that s not development. That s regression, especially when the bar was so low to begin with.
The Mariners lost tonight because the veteran starting pitcher they extended by two years to help them win did not get the job done. And because a bullpen that was supposed to be a team strength again didn t do the club any real favors.
When that happens, it has to be called as such. There has to be disappointment in losing games that should be won or else you ll wind up with a nice team of stat collectors that wins a few games when it s safe enough meaning they ve fallen too far back to have any real pressure on them and can t nail that door shut when it actually matters. This team has had plenty of chances to be close to a .500 club despite all of the injury setbacks. The reason it is 10 games under .500 is because of a penchant for losing games that are imminently winnable,[http://www.wikileakdes.org/%E5%88%A9%E7%94%A8%E8%80%85:Lavknzaimzws#Smoothie_King_opens_0 Smoothie King opens 0], as this one was tonight.
Losing those games doesn t make you a better winner later on. Winning those games does. Until this team figures out how to make its own life easier a lot more often, none of the short-lived momentum gained this year will carry over by any meaningful extent next season. So, no, you can t just shrug this one off as another loss by a rebuilding team. Losing has become too acceptable around these parts going on a decade and five years into this plan, it s not too early to expect all of that waiting to have yielded a club that knows how to keep momentum going longer than 48 hours at a time.
And when it can t do it, can t get the job done, it s OK to call the team out on it. This team had expectations this year, but at 10 games below .500, they have not beeen met. This team had expectations coming into tonight after a 5-2 week, then promptly blew a 5-1 lead with arguably their best starter on the mound.
Sense a pattern? Only the Mariners can break it. And it starts by being ticked off that they blew yet another game they had in the palm of their hands.</html>

BEAVERCREEK Public Utilities Commission shares energy and gas company options with Beavercreek residents.

Jack Keegan of the Public Utilities Commission (PUCO) visited the Greene County Public Library s Beavercreek Branch to meet with residents who wanted to learn about their choices in energy and gas companies and to gain a better understanding of options, rates and the meaning of different power sources on June 25.

So, why are you being approached now with these choices? Because other suppliers now feel they can be competitive or beat your current suppliers, Keegan said.

Over the years the electrical utility industry has taken a drastic change and the PUCO wants to make sure everyone has been educated about their choices before jumping into a decision that might be right for your business or family.

The PUCO office works to help solve utility disputes; provide payment plan information; explain utility rules and regulations; provides information regarding PUCO public hearings and how to participate; provides tips on energy conservation; and to provide speakers for civic, consumer, religious and community organizations.

To help educate the state of Ohio, the PUCO has developed an Office of Retail Competition called the ORC. The mission of the ORC office is to improve awareness of the market-based utility service in Ohio.

On the back of your bill, next to the generation charge, the name of your current generation supplier will be listed. To further understand your energy bill, on the front of the monthly statement, on the bottom, the bill will include a price-to-compare section that will tell the current price you are paying for the generation cost.

Sure, Michelle Obama has White House Chef Sam Kass and a host of other high-profile chefs to promote her goal that kids eat more healthful meals. But an actual kid? That’s where Amber Kelley of Woodinville comes in.
Amber, 10, is the Washington state winner of a nationwide  to promote “healthy, affordable, original, and delicious” meals. On the strength of her  made with thin-cut zucchini slices, she’ll dine at the White House and tour the White House garden with the First Lady and other contest winners on July 9.
“We thought it would be fun to enter and just see what happened,” Amber said before heading to Washington D.C. “I never would have dreamed of going to the White House.”
She’s already had plenty of experience in the kitchen, though — and in the spotlight.
For the past year, the fifth-grader has starred in her online  video show, now at episode 43, and she appears in regular TV guest spots on Q13. She dispenses advice and recipes for healthful potluck possibilities, for dinners such as slow-cooker turkey chili, and for treats such as “super yummy” fudgesicles using avocado and unsweetened almond milk.
She does it all with chipper, unforced cheer, plus the occasional goofy take or deadpan aside, and with the kind of genuineness that only a 10-year-old can display when giving in to the irresistible pull to hold a banana-phone to her ear before turning it into a health-friendly “fronana” dessert.

To search for files or power down a Windows 8.1 PC, you ll probably continue to?use?its charms ?controls. Microsoft has made a number of notable improvements to the start screen that may minimize the issue.

Most obvious is the ability in 8.1 to have smaller icons, allowing more programs to be shown on the initial screen. Scrolling sideways also surfaces a down arrow button that?calls up a list of all apps, accessories and system controls. This apps view ?list includes the Control Panel, file explorer and run commands.

The browser also behaves differently. Control buttons and the address bar remain visible, instead of disappearing as they do in Windows 8. The original idea was to maximize viewing area when browsing, but it s maddening to have to constantly click or flick a finger to get the browser controls back in view.?Keeping?browser?controls directly at hand is?a welcome change in Windows 8.1.
One of the most?significant changes in 8.1 lies below the surface, where Microsoft has added options for changing the default desktop.
It takes some poking around to find, but Microsoft added settings to 8.1 that let users go to the traditional desktop when they sign in on their PC.

This enables traditionalists to largely bypass the modern, Windows 8 interface.
Also added are controls for changing what happens when you press the start button. One option is to have the start button bring users back to the traditional desktop.
Another option lets the start button call up the apps view listing all apps on the system. This gives the start button some of its old oomph.
To change these settings, you launch the control panel and its appearance and personalization controls.?Clicking taskbar and navigation controls calls up a dialog box that lets you override Microsoft s preferred Windows 8 interface and take your new PC back to the future, if you choose to set it up that way.</html>

DRIVE Basketball coach Pasha Bains said Etienne is a perfect fit for the Huskies.

Just an overall great player with a lot of upside.

Washington likes to run and he can do that. He s a really bright kid. He s been a 4.0 student and he scored really well on his SAT. He s just a really good team guy. I think Washington is lucky to have him. 
Unlike Gonzaga, Washington hasn t plucked many recruits from Canada. Todd MacCulloch (1995-1999) was UW s last significant player from Canada. Former UW standout Lars Hansen (1973-76) grew up in Coquitlam, B.C.
 Washington has a very good reputation here, Bains. A lot of kids look at that as a dream. To be completely honest there s very few kids here that could go from B.C. and play at Washington. I think Robert Sacre was one. I m not sure what happened with Washington and Sacre or if he had an offer.
 But Tristan is a very rare player here. We don t get these types of players very often and I think that s why Washington stepped up and took him.

It didn t take long for baseball to come up, and for Wright to reveal he was a pitcher in the Cleveland Indians organization, at the time. A former second-round pick of the Indians out of the University of Hawaii in 2006, Wright was stymied in the minor leagues and had in fact been demoted from Triple-A to Double-A that year. At Double-A Akron,? he had begun dabbling with the knuckleball, impressively enough that his pitching coach, Greg Hibbard yeah, the ex-Mariner urged him to stick with it. But now Wright was eager to learn more about the nuances of the pitch.
Arnold told him that he just happened to be acquainted with R.A. Dickey, whose success story is an inspiration to all aspiring knuckleballers. Dickey and Arnold had hit it off during Dickey s stint with the Mariners, and they had remained in contact over the years as Dickey eventually blossomed into the Cy Young Award winner. Kirby told Wright that he could get him together with Dickey, who is always happy to play it forward after Phil Niekro and Charlie Hough helped him immensely in his own career. Wright took him up on the offer, the connection was made, and Dickey wound up talking extensively to Wright about the technical and psychological aspects of throwing the knuckleball.
And then last year, Wright s career began to take off. He went a combined 10-6 with a 2.44 ERA in the minor leagues with Cleveland and Boston, which acquired him in an unheralded July 31 trade with the Indians for first baseman Lars Anderson.

But Wright got out of the jam and went on to blank the Mariners who had been blasting the ball all over Safeco Field so far in the game over the next five innings. The result was his first major-league win and presentation of the game ball after the Red Sox rallied for a run in the 10th to win it, 8-7.
A couple of Mariners commented that Wright s knuckleball reminded them of Dickey s a little bit harder than the traditional floater. Considering the tutelage he had received from Dickey, courtesy of a helpful sportswriter from Everett, that s not a surprise.</html>

The device works by helping the patient bring their lower jaw forward. This keeps the tongue forward, preventing it from closing off the airway and allowing the patient to receive more air. The upper part of the device keeps the jaw from sliding too far back ensuring the sleep apnea patient's airway remains unobstructed by the tongue.

The troubles of electric-car-maker  have fueled another round of debate about whether plug-ins can live up to their promises. The California start-up, which had already halted production and laid off most of its employees, Monday and told a congressional hearing on Wednesday that . This is likely the end of the road for Fisker. But definitely not for electric cars. Let’s dispel some myths.
1. The electric car is dead.
This myth is partly my fault, perpetuated by the title of my 2006 documentary,  The signs back then weren’t promising. Under pressure from car companies and other lobbyists, California rolled back its Zero-Emission Vehicle mandate, which had helped get nearly 5,000 electric cars on the road. The change in the regulation freed carmakers to round up the cars they had leased — and then surreptitiously crush them.
Thankfully, it takes more than a crusher to kill a technology. Today, almost all the major automakers, along with a cast of new players, are investing in and building plug-in cars. California’s mandate has also made a comeback, and other states are considering similar rules.

That makes it all the more impressive that Fisker’s rival Tesla  this year.
A new report from IEE, part of the Edison Foundation, projects that between 5 million and 30 million electric cars will be on U.S. roads by 2035. “The electrification of the vehicle fleet is a foregone conclusion,” says former GM vice chairman (and former electric-car-basher) Bob Lutz.

Since then, partly with the help of government loans (some already repaid), electric-car technology has made big strides.
2. Electric cars can’t get people where they need to go.
I’ve been driving electric cars for 15 years and have yet to run out of power. But ask people what their biggest hesi-ta-tion is about electric vehicles, and they’re most likely to say something about the cars leaving them stranded. This myth is so pervasive that General Motors applied to trademark the name for it:  A controversial  in February of Tesla’s Model S, which ended up needing a tow to a charging station, seemed to confirm the fear.
But that test drive — covering more than 500 miles in temperatures as low as 10 degrees — was not your everyday trip. The average American drives fewer than 40 miles a day. That’s well within the 75-mile-plus range of most electric cars. And while batteries do , on a normal day Tesla’s Model S can go as far as 265 miles on a single charge.
The answer to range anxiety for many carmakers is the plug-in hybrid, an electric car with a backup gasoline engine. 3. Charging is a headache.
Charging an electric car can be as simple as plugging it into a wall outlet. But AC outlet charging is slow, taking between eight and 24 hours. So it’s not usually the method of first resort.
That’s why most plug-ins are sold with charging docks that work in a home garage and can charge a car in four to eight hours, allowing drivers to treat their cars like their cellphones: topping them off periodically or charging them up overnight.
I didn’t have my own garage when I first leased an electric car, so I often used a public charging station within walking distance of my home. There are now 5,734 public stations in the United States, many with multiple charging points. The newest generation will charge your car nearly 10 times faster than home stations and 50 times faster than an AC outlet. Tesla just installed several of these supercharger stations on the East and West coasts, and Nissan recently announced plans to install 500 in the coming months.
4. Electric cars aren’t any better for the environment.

== Mormon missionaries- 75,000 and counting – U N I V E R ==

The Church of Jesus Christ of Latter-day Saints set a major milestone when the number of missionaries currently serving hit 75,000 last week, setting a Church record for the highest number of missionaries ever to serve at once.

Since the October 2012 announcement lowering the missionary age to 18 for men and 19 for women, the Church has seen an astounding increase in missionary numbers. According to an Aug. 14 Mormon Newsroom release, there were 58,500 missionaries serving prior to the announcement. Just six months later, that number had risen to 65,000 and now a year later, 75,000 missionaries are serving across the world.

The missionary program has been expanding and growing in many respects over the past year resulting greatly from the historic announcement in October. In late January, a new Missionary Training Center was announced in Mexico City. The Mexico MTC was intended to accommodate the influx of missionaries serving Spanish-speaking missionaries, and approximately 1,500 missionaries pass through the center each month.

The surge in numbers also brought on the creation of 58 new missions, which were announced in late February. No new countries or regions were opened, but the missions were created from already existing missions.

Elder David F. Evans of the Seventy and executive director of the Missionary Department said,?��What we are doing is building and creating missions to what we expect will be needed after the peak part of the surge. 

An increased number of missions made it apparent the Provo MTC needed expansion. Plans to expand the MTC have been on the drawing board since early 2012, but neighborhood residents were in constant disagreement over buildings being more than nine stories. The current facilities can hold 3,000.

The MTC expansion, however, can t come quickly enough.  At first, our residents were shocked, just like everyone else, said?Shelly Freeman, president of Glenwood Intermountain Properties, Inc.? Overall the residents have responded very positively, and many are supportive of our decision. A few were understandably upset. We were able to help them understand the situation, and most are now fine. 

The first missionaries to stay in Raintree Commons reported in June.

As more housing became available for new missionaries, new opportunities with technology began to open as well. In a?statement made by Scott Trotter, an LDS Church spokesman, Missionaries write to their families each week and can also communicate by email with friends, priesthood leaders and new converts. 

And then the possibilities grew even more. On June 23, Elder L. Tom Perry of the Quorum of the Twelve Apostles said missionaries will now be proselyting online.

 (Many people��s) main points of contact with others, even with close friends, is often via the Internet,�� he said. ��The very nature of missionary work therefore must change if the Lord is to accomplish the work of gathering Israel from the four corners of the Earth. 

Missionaries now use Facebook, mormon.org, blogs and emails to communicate with potential investigators and to spread the gospel. The online proselyting program was piloted in several missions. Matt Lee served in the Montana Billings Mission, where the program was implemented when he arrived in 2010.

 There were a few that chose not to use the Internet for a while and then they saw the benefits of it and saw what it was used for, Lee said. ��Then they felt comfortable enough. I don��t know of anyone that never used it. 

Shifts in missionary culture continued in July, when the grooming standards for elders were completely revamped. Missionaries may now wear lighter colored suits and pants, closed-toed sandals and khakis. The Missionary Handbook was previously open to interpretation depending on the mission president, so many missions already allowed lighter suits. But this rule change was a welcome to many who had to conform to less favorable rules.

��I think the changes are an awesome idea,�� said Skyler Hair, who served in Phoenix. ��Sixty-degree weather is still relatively warm, and I remember how some people would look at us funny because we were riding bikes and wearing suit coats in warm weather.��

Church spokeswoman Ruth Todd said in May that the LDS Church estimated more than 85,000 full-time missionaries would be serving by the fall.

While department stores have long been on a slow decline, a looming question for J.C. Penney is whether it can avoid bankruptcy after spending wildly for renovations and new hires while losing shoppers. 
 There s nothing to compare with what happened since Ackman set foot at Penney, said Bernie Sosnick, an analyst at Gilford Securities. Ackman s recruitment of Johnson, who was fired as J.C. Penney s CEO in April, and Johnson s team probably racked up $200 million in personal expenditures alone, he said.
Johnson, who viewed himself as a kind of retail Steve Jobs,  of bad decisions and poor management that ultimately led to the sales plunge and a nearly $1 billion loss during his year in charge. But the 47-year-old Ackman played an extraordinarily outsized role for a board member, not only recruiting Johnson but also coaching and counseling him each step of the way.
 Ackman told us more than once that he consulted with Johnson on a daily basis, Sosnick said. He was active in moving Johnson along this destructive force that brought Penney to the verge of bankruptcy in one year. 
Even as Johnson s ideas appeared to be falling flat quarter after quarter, Ackman insisted that he was on the right track. Customers would soon embrace eliminating sales and coupons, Ackman said. The boutiques implemented in stores would generate sales-per-square foot that would rival major shopping mall companies like General Growth Properties and the stock could well exceed $100 a share over time, he said. Then he missed a week with a knee injury and a death in the family. He did improve. He had several good practice days, starting on Aug. 13, Day 13 of camp. He threw well Tuesday and Wednesday. He could use a good showing in Washington on Saturday.
Defensive co-MVPs: Alex Carrington and Jerry Hughes. Carrington was a consistent force at defensive end. He s stout. Hughes got pressure off the edge day after day. The Bills desperately need him to produce because the pass rush depth is questionable. So far, so good.
Hughes, acquired in the deal that sent Kelvin Sheppard to Indianapolis, said the fact he arrived in May was a big help.
 Any time you get comfortable with the playbook and you know your job you can kind of pin your ears back and let it rip.
 It was great that I kind of came in when I did back in the spring. I came in early May and was able to get my hands on the playbook and get in the office with Coach O Neil and put in the time to get caught up, Hughes said, referring to linebackers coach Jim O Neil. Once I was able to catch up with everyone else, I was able to play football. 
Young WRs shine: Second-year man T.J. Graham and rookies Robert Woods and Marquise Goodwin all had good camps. The Bills are counting on all three to contribute right away. The battle for the last spot or two on the WR corps is intense.
LG battle not hot: No one has put a stranglehold on the left guard job. Colin Brown is No. 1 for now. He s stout but doesn t move too well. Doug Legursky can move but he has a small frame. The Bills are working Antoine Caldwell mostly at right guard. It doesn t look like there s an ideal answer.
O-line depth is a worry: Chris Hairston has proved he is a capable No. 3 tackle and was expected to push Erik Pears at right tackle. Hairston remains on the physically unable to perform list. The next tackles, Thomas Welch and Sam Young, haven t showed so far that they re as good as a healthy Hairston. After them are 5-8 rookie Nickell Robey and Crezdon Butler, who has played better in the two preseason games than in practice.
Kiko on the move: Rookie Kiko Alonso, the second-round pick from Oregon, looks like a sideline-to-sideline tackling machine. He s always on the field. In fact, the Bills fitness staff has small monitors on the backs of the players shoulder pads that log how far each player is running every day. Alonso was rested last week simply because he was on the move so much.
Young legs: The kicking competitions were won by place-kicker Dustin Hopkins and punter Shawn Powell, both of whom clearly had the more powerful legs.

Two weeks before the start of school on Tuesday, nearly 100 college bound Windsor High School juniors and seniors were already at their desks.

They attended a free, six-day class that prepared them for the SAT test they will take as part of the college admissions process, and also were informed about financial aid options.

Their mentors were Windsor High School alumni Amy, Peter and Jonathan Jeffrey, who developed and first taught the class in 2012.

Amy and Jonathan are enrolled at Harvard University, and Peter attends the Wharton School of Business at the University of Pennsylvania.

The Jeffrey siblings say high school students are comfortable about college from familiar faces.

“It’s helpful to hear from those who have gone through the process. It’s less stressful,” Amy said.

Windsor High School students used a study guide book with sample SAT questions to prepare for the test. The high school administration provided space at the high school and paid for the study guides.

Half the students take the test twice, once during the spring of their junior year and again in the fall of their senior year.

“It will be the longest test they take. It requires endurance,” Peter said. “Knowing what to expect and that it will take time is helpful. We tell them to do the best you can and get some sleep the night before the test.”

Instruction about financial aid helps students fill out forms, learn about grants, scholarships, loans, work-study programs and military service as a means to pay for college, Amy said.

This year the Jeffreys were joined by Vanessa Padilla, a junior at St.?Mary’s College of California in Moraga who helped them teach the class.?

Other Windsor High alumni who attend Sonoma State University, UC Berkeley and the United States Military Academy at West Point talked about the social aspects of college.

Peter said students are advised not to have their heart set on one “dream” college or university.

Windsor High School Vice Principal Chris Vetrano said the Jeffreys are personable, friendly and get great results from students in the class. “We’re happy to have them,” she said.

The high school has three full-time counselors and one half-time college and career advisor who serve a student body of 1,800, Vetrano said.

“If you take an SAT class online, it can cost several hundred dollars. Having a class for a week is a gift to the high school,” she said. “We are grateful they do this without compensation.

“Amy talks about the mindset you need to be a success in college and the advantage of going to a four-year college instead of a junior college first.”

Some students take several years to finish junior college and never go on to a four-year college, Vetrano said.

Vetrano and the school’s guidance counselors did “a great job” recruiting college bound students for this year’s class, Peter said.

She is considering a career in the foreign service and said she valued the one-on-one talks with the graduates during last year’s class.

“It broadened my horizon and made me believe I could do more than I thought I could,” Sheber said. “A lot of students come to the class because the Jeffreys are teaching it.”

Some students are apprehensive about choosing a major and deciding whether to attend a college out of state, Peter said.

“Seeing high school graduates say they didn’t know what they wanted to do shows them they don’t need a set plan to benefit from the college experience,” Peter said.

“It’s important the students understand the dynamics about going away to college,” adds Jonathan. “They should at least apply. We let people know what’s out there.”

He is studying history and government, Peter is majoring in finance, and Amy is focused on computer science and economics.

“Taking the SAT is never going to be fun, but we say this class is the most fun it can be,” Peter said.

Whether the Jeffreys will participate in the class next year is unknown.

“In a few years we won’t be seen as recent Windsor High School graduates,” Peter said.

Each year more than 2 million students take the 3-hour, 45-minute SAT, which measures critical reading, math and writing.

SAT scores range between 200 and 800 points, with average scores in 2012 of 496 on the critical reading test, 514 on the math and 488 on the writing test.

Eighty percent of the students finish nearly the entire test, and almost all students complete at least 75 percent of the questions.

== The Evolution of BitTorrent’s Legality ==

At any given instant, it is claimed BitTorrent has more users than YouTube and Facebook combined. Approximately 70% of all internet traffic is BitTorrent peer-to-peer (“P2P”) activity.

The popularity of BitTorrent has made it a natural choice for pirates looking to illegally distribute copyrighted material. From 2010-2012 more than 250,000 people were accused of illegally downloading movies off the internet using BitTorrent. Record companies, music production companies, the software industry and more are now pursuing people who use BitTorrent to download their copyrighted material. 

In this article we will detail how P2P programs have evolved in response to legal liability for their creators, and we will end with showing how the users of BitTorrent are hauled into court. While downloading copyrighted material on BitTorrent may seem like the easiest option, it is always easier and cheaper in the end to buy the material in the first place.

Napster – First Generation File Sharing



Napster was the first program that facilitated widespread P2P file sharing. Napster provided a central server that allowed users to find other users who had the files they wanted to download. The user would then download the requested file directly from the other user that had it on their computer.

In the first major case to address legal liability for copyright infringement committed via P2P file-sharing, the Ninth Circuit Court of Appeals found the creators of Napster liable for contributing to their users’ copyright infringement. The court focused on Napster’s failure to filter its servers to remove copyrighted material. The court ruled that since Napster controlled their central servers, Napster had the right and ability to supervise the downloading occurring through their servers.

Grokster – Second Generation File Sharing



The founders of the “second generation” P2P programs, such as Grokster and Kazaa, learned from the Napster ruling and created networks that did not run from a central server. Users were able to trade files directly between each other and the creators of the programs hoped to avoid liability because, in contrast to Napster, they could not control what their users shared.

Grokster would assign users as “supernodes,” who acted as a central server for all file-sharing requests to pass through. The users designated as “supernodes” could change from day to day. 

The United States Supreme Court unanimously held that the creators of Grokster were liable for contributory infringement because they intended to bring about infringement by distributing a device suitable for infringing use that actually facilitated infringement. 

Grokster’s creators were liable because they profited from their user’s infringement through advertising and also because they took active steps to encourage infringement by their users.

BitTorrent – Third Generation File Sharing



BitTorrent is now the “third generation” and dominant P2P file-sharing application used on the Internet because it can transfer large amounts of data quickly and cheaply. BitTorrent facilitates the transfer of large files by breaking down data into smaller pieces and sending those small pieces to downloaders requesting the file. Once the leaches get all the pieces of the file they desire the file is reassembled as a whole.

Everyone involved in sending and receiving pieces of one file is a member of the same “swarm.” Users in a swarm with 100% of the data are called “seeders,” while everyone else trying to acquire 100% of the data is called a “leech.” Like Grokster,[http://rdbg.tuxic.nl/wiki/dw/de/index.php/Benutzer:Lxkaeijnjoqg#No_injuries_reported_in_Cornwall.2C_Ont..2C_chemical_plant_explo No injuries reported in Cornwall, Ont., chemical plant explo], BitTorrent does not require a central server. BitTorrent allows users to transfer files to other users in the “swarm,” instead of directly from the file distributor. 

Courts have not yet determined whether the creators of BitTorrent are liable for contributing to copyright infringement, but if this question was before a court they would likely focus on whether BitTorrent’s creators intend for their users to commit copyright infringement. The creator of a company similar to BitTorrent, isoHunt,[http://dogpedia.com.br/wiki/Usu%C3%A1rio:Lifanormtana#Miller_won.27t_go_.27the_way_Roberto_did.27 Miller won't go 'the way Roberto did'], was recently found liable for copyright infringement by the Ninth Circuit Court of Appeals.

While the liability of BitTorrent’s creators may still be an undecided legal question, there is no question that the people who use BitTorrent to download copyrighted material without permission are liable for copyright infringement.

BitTorrent Users Are Liable For Copyright Infringement

While transmitting and receiving data from a torrent, each computer leaves its fingerprint in the form of its IP address. Attorneys then go to court to subpoena the internet provider for the IP address to get the name of the person behind the IP address.

Copyright holders are now attempting to assert claims against unknown defendants who are only identified by their IP addresses, and then joining large numbers of those defendants into single legal actions. The defendants are only identified as “John Doe” until the copyright owner requests early discovery and leave from the court to ’ Internet Service Providers (“ISP”) to identify each John Doe.

Under Federal Rule of Civil Procedure (FRCP) 20(a) parties may be joined in one action if their potential liability arises out of the same transaction or occurrence. Copyright holders are joining together all members of a BitTorrent “swarm” are engaging in the same transaction.

Some courts have decided that cases involving huge number of “John Doe” defendants are an improper use of the legal system because they lump very different factual scenarios together into one case and use one filing fee to pursue a suit, instead of paying hundreds or thousands of filing fees. Copyright liability can be very expensive and if a court determines you are liable for willful infringement the judgment amount is not dischargeable in bankruptcy.

Some people have called this type of litigation “trolling”, meaning that the troll demands a payment to cross his bridge. The truth is there appear to be some unscrupulous companies and lawyers abusing the system. Many cases, however, are legitimate. 

Could you be next?

If you have been sued for copyright infringement via BitTorrent do not ignore it. Hire a lawyer who is an expert in intellectual property. After consulting with your lawyer, you may very well come to the conclusion that settlement before trial is your best option. Further, John Does in these situations are liable for attorney’s fees, so fighting a claim just for the sake of fighting it can be very expensive.

If you use BitTorrent to download copyrighted material, stop doing it. There is a real risk that you will be identified, sued in federal court, and in the end forced to pay much more than it would have cost you to just buy the material in the first place instead of downloading it.

Here are three key problems, as explained to me by Christopher Wimer, a researcher at Columbia.
 1. It doesn't account for geographic differences. The poverty line is the same, no matter where you live — whether it's in New York City or rural South Dakota.
 2. It's based on a 50-year-old formula that assumes Americans spend about a third of their income on food.  3. It doesn't consider the value of of government benefits, such as food stamps and tax credits.
 Changing the formula would require overcoming lots of political obstacles, Wimer says. Government money for services such as housing aid and Medicaid is tied to the poverty line. "Any sort of official change to that means there's a lot of sort of winners and losers, and so it's hard to monkey with that too much," Wimer says.
 And describing poverty can be complicated. Some low-income college students are supported by their families, but others aren't — and it's not easy to differentiate the two.
 Still, in response to all the concerns, the government has started to issue something called a supplemental poverty measure. == The Cost of Raising the Next Serena Williams or Roger Federe ==

“I spend about $2,000 a month on private lessons,” she says. “He does about three times a week, depending on if it’s a good week or not. I am on the low-end: I don’t travel out of state for tournaments, because I don’t have the money to do that.”

The eight hours a week Lisa spends driving Brett to and from matches and lessons is just the beginning of the sacrifice parents make in hopes of helping their children make it into the world of professional tennis, or any sport for that matter. She says the family recognized a special talent in Brett from a young age, and felt it was worth pursuing. That being said, she knows his odds of playing in the U.S. Open are slim.

“He was good at other sports but just gave up basketball this year, his coaches told him he had to. Breaking Down the Basics

The cost of private lessons vary by region, according to Keller, ranging anywhere between $40 and $100 an hour in areas like Little Rock, Ark., and New York City, respectively. While the equipment needs are minimal compared to other sports, it’s still not cheap. Shoes can cost around $100 on the high end for kids, and $35 on the low end, Keller estimates. Children’s’ rackets cost around $25, but can be hundreds of dollars by the time they are teen players.

Then comes the travel, says Jeff Hoffman, CEO of Athletic Resource, a recruiting company that works with high school athletes. Competitive tennis tends to require a lot of travel to tournaments. “There are expectations of practice that you have to achieve,” he says. “In a high school team, that practice level will drop off. If you want to compete at the highest level, you need to stay at that level for that reason.”

Raising a Pro: What are the Odds?

Having your child grow up to be the next Maria Sharapova is essentially like hitting the lottery, says Keller.

Even playing in college can be a reach for most young tennis players. According to , only about 10,000 men and women continue to play competitively in college. Advancing beyond that is even harder and rarer.

“Those tennis players are something special, and their parents know at an early age they have something special,” he says. “They can read the ball, and know where it’s headed. Even in college, there’s only around 20,000 positions available, and that is great odds.”

Even Lisa admits it’s a long shot, but if Brett plays in college, she says she will be thrilled.

“Very few American kids make it to the pros, because so many kids outside the U.S. are getting trained in tennis to come to school here,” she says. “We have something special, and he is good. But believe it or not, there’s a million kids who have something special in tennis.”</html>

Hernandez, 23, pleaded not guilty to murder and weapons charges in June, and he is being held without bail at a county jail. His lawyers say the case against him is circumstantial and they re confident he will be able to clear his name.

Hernandez signed a new Patriots contract last summer worth $40 million but was cut from the team within hours of his June 26 arrest, when police led the handcuffed athlete from his home as news cameras rolled.

He could face life in prison if convicted. He was due to appear in Attleboro court later Thursday.

A jogger found Lloyd s body on June 17 in a North Attleborough industrial park. His mother, Ursula Ward, called him a loving son who never hurt anyone and implored law enforcement officials to get justice for his slaying.

Prosecutors say Hernandez orchestrated Lloyd s killing because he was upset at him for talking to people Hernandez had problems with at a nightclub days earlier. Authorities have said they haven t found the murder weapon, which they believe was a .45-caliber Glock pistol. But they recovered a magazine for .45-caliber bullets in Hernandez s Hummer as well as ammunition of the same caliber inside a condo he rented in Franklin, Mass.

Authorities also recovered a shell casing that matched those found at the homicide scene after tracking the rental car Hernandez was in the night Lloyd died.

Since then, Boston police have asked police in Hernandez s hometown of Bristol, Conn., for their help with the probe into Lloyd s homicide as well as a 2012 double homicide near a Boston nightclub. A Connecticut police lieutenant said authorities searched the home of Hernandez s uncle, seizing an SUV sought in the double killing that had been rented in Hernandez s name.

Two men died in the July 2012 shooting in Boston s South End, with witnesses reporting that gunfire came from inside a gray SUV with Rhode Island tags. Boston police haven t reported any arrests in the deaths of 29-year-old Daniel Jorge Correia de Abreu and 28-year-old Safiro Teixeira Furtado and won t comment on whether Hernandez is a suspect.

Hernandez is also facing civil litigation after a Connecticut man filed a lawsuit asserting the former player shot him in the face in February after they argued at a Miami strip club. Alexander Bradley, who says he lost an eye, told police at the time he didn t know who shot him.

MHSA is the only Milwaukee public high school using the program, called Ignition. But Todd Gehrmann, who founded Focus Training 21 years ago, said the group works with other local schools such as St. Francis High School and Brown Deer High School. Their school clients include 250 to 300 schools out of state, from Wyoming to Alaska.

The company's school-centered training programs, which target helping students transition to high school and to college, make up the bulk of their work, Gehrmann said. But the resurgence in corporate training requests post-recession has fueled recent revenue growth.

 I don't want to jinx us, but this year has been our busiest year ever, Gehrmann said. We're looking at 80% to 100% growth. 

Gehrmann is an MPS parent with kids at Golda Meir and said he's excited to be working with the district for the first time.

The best ratio at the high school level, Gehlmann said, is to have two upperclass mentors work with about 10 freshmen. Gehrmann said most contracts with schools range from $2,000 to $12,000 for one year of the program.
