== Senate questions FBI nominee Comey on torture, Boston bombin ==

<html>In testimony before the Senate Judiciary Committee, Comey said that he believed the 1994 statute governing interrogation tactics was vague, and while he tried to fight the administration to halt waterboarding, he was unsuccessful.
Sen. Patrick Leahy, D-Vt., chairman of the panel, expressed concerns over the memos Comey had signed while at Justice, but ultimately received a promise from the nominee that he believed waterboarding to be torture.
"These memos led to the treatment of detainees that was contrary to our laws and our values, and this frankly made us less safe," Leahy said.
 If confirmed by the Senate, Comey, a former federal prosecutor, would succeed FBI Director James Mueller. His background appears to have secured support on Capital Hill, but civil liberties groups have voiced concerns about his record of signing off on tactics employed by the Bush administration to go after and prosecute suspected terrorists.
Comey stood firm, however, against some of those methods in a now-famous nighttime episode at the hospital bedside of then-Attorney General John Ashcroft, when top Bush administration officials tried to get the ailing Ashcroft to approve warrantless surveillance.
Legislators questioned Comey on a variety of current topics, including the recently-public NSA surveillance program, government whistleblowers and the force-feeding of Guantanamo inmates. 
He told Sen. Sen. Jeff Sessions, R-Ala., asked him about the wisdom of trying terrorists in criminal courts, versus military courts.
